Types of Divorce in Georgia

Our experienced Georgia divorce attorneys can help you confidently navigate both types of divorce with a results-driven focus.

Uncontested Divorce

When a couple agrees on all the issues in their divorce - including custody, property division, child support, and alimony - then they do not need to ask the court to make those decisions for them and can achieve an uncontested divorce. Divorces that do not escalate to court tend to be cheaper, faster, and less contentious.

Many times, couples will engage in a process called mediation if they have some outstanding disagreements but can work together to keep their divorce out of court. In mediation, a neutral third party mediator facilitates discussion between the spouses in order to find areas of compromise, ideally leading to a full agreement. Mediation also offers the benefit of privacy.

Contested Divorce

When couples do not or cannot agree, the case becomes contested and goes before a judge who hears evidence and arguments from each party’s attorney before they make the final decisions. These types of divorces tend to take longer and be more expensive. Furthermore, the details of each case typically become public record.

Navigating Key Divorce Issues with the Support of Our Dedicated Georgia Divorce Lawyers

Child Custody and Child Support

There are two components to custody in Georgia: legal custody and physical custody. Legal custody refers to the right a parent has to make important decisions about the child’s upbringing, while physical custody refers to who the child lives with the majority of the time. Custody can either be shared by both parents (joint) or allocated to one parent only (sole).

You and your spouse have the opportunity to create your own custody arrangement that works for your family, which our Georgia divorce lawyers can assist with. However, if you cannot reach an agreement, the final decision will be left in the hands of a judge, based on what is in the best interests of the children.

Asset and Debt Division

Georgia is not a community property state, where each spouse is entitled to an equal 50% share of the assets and debts. Instead, we divide things “equitably,” or fairly. Again, you and your spouse have the opportunity to reach your own agreement about how you will divide your marital property, and our skilled Georgia divorce lawyers can negotiate on your behalf to protect your interests.

However, if you cannot reach an agreement, the court will make the final decision based on factors like each spouse’s income and earning potential, how long the marriage lasted, contributions to the marriage, and more.

Spousal Support (Alimony)

Either spouse is allowed to ask for alimony, but the court will only grant it if it’s necessary. A judge will consider several factors like the duration of the marriage, the financial resources of each spouse, each spouse’s contributions to the marriage, and more. If alimony plays a part in your divorce, our Georgia divorce lawyers will ensure a fair arrangement is in place, whether you are the paying or receiving party.
